New Delhi (Vishvas News). A social media post is going viral, claiming that the Allahabad High Court has returned 12 acres of land belonging to the Banke Bihari temple in Mathura. The post further alleges that this land was previously given to a Muslim trust for a cemetery by former Chief Minister Akhilesh Yadav.
Vishvas News investigated the viral post and found it to be misleading. A news report from 2023 is being falsely circulated as a recent development. The verdict regarding land registered under the name of the temple Banke Bihari Ji Maharaj in Shahpur village, Chhata tehsil, Mathura is being misrepresented with incorrect references.
What is going viral
On March 4, Facebook user ‘Ajay Kumar Soni’ posted with the caption, “Allahabad High Court has given a historic verdict. The court has returned 12 acres of land of Banke Bihari temple in Mathura. This land was illegally given to a Muslim trust for a cemetery overnight by former Chief Minister Akhilesh Yadav. The Hon’ble Court said that this case is unique in the world, where the land of a Hindu temple was suddenly transferred to another group without any valid reason. Imagine what will happen if such a leader comes to power again! How many more unjust acts will occur? Today justice has prevailed and the temple land has been rightfully returned. Thanks to the court for ensuring fairness.”

Investigation
Vishvas News first used Google Open Search Tool to verify the truth behind the viral claim. Relevant keywords were created based on the related claim and searched online. We did not find any recent news confirming that the Allahabad High Court had issued such a decision recently. All the reports found were from September 2023.
The whole matter was explained in detail in a news article published on Jagran.com on 17 September 2023. According to the news, “The Allahabad High Court has quashed the orders regarding registering the land registered in the name of Temple Banke Bihari Ji Maharaj located in Shahpur village of Chhata tehsil of Mathura in the name of Gram Sabha on 13 August 1970 and then registering it as a pond by the order of 30 October 1991 after 21 years. The court has directed the Tehsildar / SDM to complete the process of registering the land in the name of Temple Banke Bihari Ji Virajman within a month. While hearing the petition of Shri Bihari Ji Seva Trust, Justice Saurabh Srivastava has made it clear in his order that the land of the temple and the cemetery are different. They have nothing to do with each other. In the year 2004, Bhola Khan and others submitted an application to the Chief Minister demanding registration of graveyard on plot numbers 1081 and 108/4, 108/5 and 1093/190. After this, on 13 December 2004, all three plots were registered in the name of UP Sunni Central Waqf Board. Later, plot 1081 was also registered in the name of the graveyard. On coming to know about this, the villagers submitted an application to the Sub-Divisional Magistrate on 16 June 2020. An eight-member committee was formed. It submitted the investigation report. It was asked to remove the name of the graveyard from plot 1081, but even after several applications, nothing could be done. On November 5, 2021, the petitioner submitted an application to correct the record.”

During our investigation, we found a video report on Republic Bharat’s YouTube channel from 18 September 2023. The report stated that the land belonging to Lord Banke Bihari in Shahpur village, Chhata tehsil, Mathura was initially registered as a pond and later as a graveyard. The Allahabad High Court has given its verdict on this matter.
Between 2003 and 2007, Uttar Pradesh was governed by Samajwadi Party, with Mulayam Singh Yadav serving as Chief Minister.
Continuing our investigation, we contacted Dainik Jagran, Mathura’s editorial in-charge Vineet Mishra. He confirmed that the case is old and the court’s decision came in 2023. This land belongs to Banke Bihari Ji Maharaj, Shahpur village, Chhata tehsil, Mathura.
Towards the end of the investigation, we scanned the Facebook profile of the user Ajay Kumar Soni, who posted the viral post and found that the user has over 400 followers. The number of his Facebook friends is more than three thousand.
Conclusion: Vishvas News’ investigation revealed that in 2023, a decision was given regarding the land related to the temple Banke Bihari Ji Maharaj in Shahpur village, Chhata tehsil, Mathura. The same decision is now being misrepresented with a misleading claim.
