| - Fact Check: Arvind Kejriwal’s 2012 Remarks on Congress Constitution Misrepresented as Attack on Indian Constitution
In 2012, former Delhi Chief Minister Arvind Kejriwal targeted the Congress party, saying that their constitution contains such absurdities that it seems as if someone wrote it after drinking alcohol. An edited part of his statement is being shared on social media, making it appear as though he was referring to the constitution of the country, when in fact, he was taking a dig at the Congress party’s constitution.

New Delhi (Vishvas News). Aam Aadmi Party (AAP) and Arvind Kejriwal are continuously target the Bharatiya Janata Party (BJP) over the Ambedkar controversy. In this context, a video clip of Arvind Kejriwal is going viral on social media, claiming that during a program he allegedly said that whoever wrote the Constitution must have written it after drinking alcohol. Users are sharing this clip with claims that Kejriwal made this statement targeting Bhimrao Ambedkar.
In its investigation, Vishvas News found this claim to be false. The viral statement has been made regarding the ‘Congress constitution’, which has been edited to omit the reference to Congress.
About 12 years ago, Kejriwal made this statement at Rajghat, Delhi, targeting the Congress Party’s constitution, however, the context has been removed from the viral clip, making it appear as if the statement was about the country’s Constitution, whereas it was a remark mocking the Constitution of Congress.
What is viral?
Social media user ‘Kapil Mishra For Delhi CM’ shared the viral video clip (archive link) with the caption, “Whoever wrote the constitution must have done so after consuming alcohol. This is the same Kejriwal who used such words for the person who wrote the constitution… today this Thuggalal is roaming around posing as a devotee of Baba Saheb in the greed of a few votes.”
The video clip has been shared on several other social media platforms with similar claims.
Investigation
The viral video is nine seconds long, in which Arvind Kejriwal is heard saying, “…So we were sitting … someone was saying that the person who wrote the Constitution must have written it after drinking alcohol…!”
Upon listening to the video clip, it is evident that this excerpt has been shared out of context. To find the original clip, we did a reverse image search using the keyframes and found the original video clip on the official YouTube channel of AAP, uploaded on December 3, 2012. It is a recording of Arvind Kejriwal’s speech delivered at Rajghat, Delhi on November 25, 2012.
The viral video is from a day after the formation of AAP. In this speech, Kejriwal targeted other political parties, emphasising that his party’s constitution was different. While targeting the Congress party’s constitution, he said, “The constitution of the party that we adopted yesterday…is a constitution of its own kind. Tomorrow morning the party’s website will be announced…a new website is being made…it has been being made for many days. That website will be launched tomorrow…we will put the party’s constitution on it…you people should also see how it is different from other parties? The constitution of other parties is false…they do not even accept their constitution.”
Following this, he takes a dig at the Congress by saying, “Like the Congress constitution says that every Congressman will spin the charkha…any Congressman is spinning it…have you seen any Congressman spinning the charkha…you can see it on the Election Commission’s website…during this time I have read the constitutions of all the parties…the Congress constitution says that no Congressman will drink alcohol…so we were sitting…someone was saying that the one who would have written the constitution must have written it after drinking alcohol.”
Our investigation confirms that Arvind Kejriwal’s statement was not about the Indian Constitution but referred to the Constitution of the Congress Party.
Congress is protesting and demanding Home Minister Amit Shah’s resignation over his statement on Bhimrao Ambedkar in the Rajya Sabha (see report). Meanwhile, AAP has also joined the criticism, targeting the BJP on this issue through AI-generated videos shared from its official handle.
Meanwhile, the BJP has accused Congress of distorting Shah’s statement and in response, Amit Shah held a press conference to present his side and accused Congress of spreading confusion.
It is noteworthy that the winter session of Parliament was tumultuous.
We contacted AAP’s spokesperson Anmol Panwar regarding the viral video clip and he confirmed that the ‘video clip is fake’.
The viral video clip was shared by a fan page of Kapil Mishra, which has around 20000 followers on Facebook.
Conclusion: In 2012, former Delhi Chief Minister Arvind Kejriwal targeted the Congress party, saying that their constitution contains such absurdities that it seems as if someone wrote it after drinking alcohol. An edited part of his statement is being shared on social media, making it appear as though he was referring to the constitution of the country, when in fact, he was taking a dig at the Congress party’s constitution.
